1. Not a Government Entity

DevilLeads is a private lead generation company. We are not affiliated with or endorsed by the U.S. government, the Centers for Medicare & Medicaid Services (CMS), or the Medicare program. Any use of the term "Medicare" on this site refers to the federal health insurance program, and does not imply government sponsorship of our services.

2. TCPA Consent

The Telephone Consumer Protection Act (TCPA) requires prior express written or verbal consent before a consumer is contacted by phone, text message, or autodialer for marketing purposes. By submitting contact information through a DevilLeads campaign, a consumer confirms that:

  • They are providing express consent to be contacted by a licensed insurance agent or agency regarding Medicare Advantage, Medicare Supplement, and/or Part D plans.
  • Contact may occur by telephone, including calls made using an automatic telephone dialing system or prerecorded voice, and/or by text message.
  • Consent is not a condition of purchasing any product or service, and standard message and data rates may apply where relevant.
  • They may revoke consent at any time by requesting to be placed on our do-not-call list or by opting out through the method provided at the time of contact.

Consent language, timestamp, and source information are retained for every lead generated and are available to buyers for compliance review.

3. CMS Medicare Marketing Guidelines

Campaign scripts, landing pages, and consent language used by DevilLeads are designed to align with the CMS Medicare Communications and Marketing Guidelines (MCMG), including:

  • Clear disclosure that a licensed insurance agent may contact the consumer regarding Medicare plans.
  • No use of the Medicare name, CMS logo, or Department of Health and Human Services logo in a manner that implies government endorsement.
  • No requirement to provide personal contact information as a condition of receiving Medicare plan information.

DevilLeads generates and delivers leads on behalf of licensed buyers. We do not sell insurance directly to consumers, and we do not provide plan advice or enrollment services. Licensed agents and agencies that purchase our leads are independently responsible for complying with CMS marketing and enrollment rules applicable to their own conduct.

4. Call Recording Disclosure

Qualification and verification calls made as part of our campaigns may be recorded for quality assurance, training, and compliance documentation purposes. Where required by state law, callers are notified at the start of the call that it may be recorded, and the call proceeds only with the caller's continued participation constituting consent to that recording.

5. SMS & Text Messaging Consent

Where a campaign includes text message outreach, consumers separately confirm consent to receive text messages regarding Medicare plans. Message frequency varies by campaign, and standard message and data rates may apply. Consumers may opt out of text messages at any time by replying STOP, in accordance with CTIA guidelines and applicable law.

6. State Telemarketing Law Compliance

In addition to federal TCPA requirements, many states impose their own telemarketing consent, calling-hour, and registration requirements. Our campaigns are built to account for applicable state-level telemarketing rules in the states where we generate leads, and Buyers remain independently responsible for complying with state requirements in their own follow-up contact.

7. National Do-Not-Call Registry

Consumers who provide express written consent to be contacted about Medicare plans are, under the TCPA and Telemarketing Sales Rule, contactable notwithstanding their registration on the National Do-Not-Call Registry, for the specific purpose and duration described in that consent. Consumers may still opt out of further contact at any time as described in Section 8.

8. Do-Not-Call and Opt-Out Requests

Consumers may request to opt out of future contact at any time. Opt-out and do-not-call requests are honored and suppressed from future campaigns in accordance with TCPA and applicable state telemarketing requirements. Buyers receiving leads from DevilLeads are responsible for honoring opt-out and do-not-call requests made directly to them during follow-up contact.
